These Terms & Conditions govern all bookings, rentals, and guided experiences offered through Appalachian Motorcycle Adventure Tours, LLC (“AMAT”). By booking a tour or rental, you agree to these terms.
1. Independent Operators
AMAT operates and manages its own tours and rental services. In certain cases, AMAT may partner with independent operators or third-party service providers. AMAT does not control or assume liability for the acts, omissions, or negligence of any third-party provider.
2. Assumption of Risk
Motorcycle riding and outdoor adventure activities involve inherent risks, including injury, property damage, equipment failure, and environmental hazards. By participating, you voluntarily assume all risks and agree that AMAT, its owners, and affiliates shall not be held liable for any loss, injury, damage, or incident that occurs before, during, or after the activity.
3. Accuracy of Information
AMAT makes every effort to provide accurate and up-to-date information regarding tours, rentals, pricing, and availability. However, details may change without notice. AMAT does not guarantee that all information on the website or booking system will be error-free or current at all times.
4. Booking, Cancellation, and Refund Policy
- 4.1 Customer Cancellations
- Cancellations 30 days or less before the tour date will incur a 100% cancellation fee.
- No refunds are issued for late cancellations, no-shows, or failure to meet participation requirements.
- 4.2 Operator Cancellations
- AMAT reserves the right to cancel a tour at any time, for any reason, including weather, safety concerns, or operational issues.
- If AMAT cancels a tour for operational or safety reasons, customers will receive a full refund or may reschedule at no charge.
- 4.3 Cancellations for Rider Ineligibility
- AMAT may cancel a booking with no refund if a customer:
- Does not possess the required motorcycle license
- Lacks the required riding experience
- Fails to demonstrate safe riding ability
- Arrives without required safety equipment
- Violates any safety instruction provided by staff
- These requirements are in place to protect the safety of all participants.
5. Rental Deposits and Damage Responsibility
- 5.1 Security Deposit
- For all motorcycle rentals, a $500 security deposit will be placed on the renter’s card prior to departure.
- The deposit is fully refundable if the motorcycle and equipment are returned without damage.
- The renter is responsible for all damage, misuse, or loss beyond normal wear.
- 5.2 Damage and Incident Fees
- AMAT reserves the right to charge for:
- Repair or replacement of damaged parts or equipment
- Excessive cleaning fees
- Towing, recovery, or field retrieval
- Loss of keys, accessories, or safety gear
6. Participant Requirements
- All participants must:
- Sign our Release of Liability Waiver
- Upload a copy of a valid motorcycle license for all participants.
- If renting a motorcycle, complete our
Rental Agreement
- Follow staff instructions at all times
- Wear appropriate safety gear
- Operate equipment safely and lawfully
- AMAT reserves the right to deny participation or remove any participant who poses a safety risk.
7. Privacy
Customer information is used solely for booking management, communication, and operational purposes. AMAT does not sell or share personal information with unaffiliated third parties.
8. Limitation of Liability
- To the fullest extent permitted by law, AMAT disclaims all liability for:
- Personal injury
- Property damage
- Loss of personal belongings
- Indirect, incidental, or consequential damages
- Participation is entirely at your own risk.
9. Intellectual Property
All content on the AMAT website and booking platform—including text, images, graphics, and media—is the property of AMAT or used with permission. No content may be copied, reproduced, or distributed without written consent.
10. Governing Law
These Terms & Conditions are governed by the laws of the State of West Virginia, without regard to conflict-of-law rules. Any disputes shall be resolved in West Virginia courts.
